Navigating regulatory challenges, like CSSF Circular 18/698, may seem daunting at first. However, these regulations present an opportunity to enhance your compliance frameworks. By adopting efficient, risk-based approaches tailored to actual risk exposures, you can avoid overburdening your business while effectively fulfilling regulatory requirements.

Although there is no clear prescription of the form or frequency of these KPIs, industry players are making strides. Initiatives like the Findel Group in December 2022 and the industry-driven KPI Working Group for Distribution Oversight in March 2022 are working towards standardised KPI templates.

On the distributor side, awareness about the importance of regular KPIs for asset managers and management companies (ManCo) is still growing. In Luxembourg, compliance with CSSF 18/698 is becoming increasingly evident, with KPIs now being a significant part of the CSSF agenda, especially during onsite inspections.
